Please read these terms carefully before using SmartSteals platform.

1. Acceptance of Terms

By accessing and using SmartSteals ("the Service," "our platform," "the website"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and SmartSteals. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

SmartSteals is a deals aggregation platform that helps users find discounts, offers, and deals from a variety of online retailers. Our mission is to take the hassle out of everyday shopping by using smart systems to analyze deals from various stores.

Important: SmartSteals sources deals from a variety of retailers, but we do not scour the entire internet. While we work hard to find and verify deals from various stores, there may be other deals available elsewhere that we haven't captured. We continuously work to expand our retail coverage to provide you with more opportunities to save.

Our Service includes:

  • • Personalized deal recommendations based on user preferences
  • • Deal search and categorization tools
  • • User accounts for saving favorite deals and customizing preferences
  • • Email notifications for deals and platform updates
  • • Continuous expansion of our retail coverage

2A. iOS Mobile App Terms

Acknowledgment of Apple Terms

If you are using our iOS application, these terms apply in addition to the standard Terms of Service:

  • • Apple Not Responsible: You acknowledge that Apple has no obligation to provide maintenance or support for the SmartSteals app. Apple is not responsible for addressing any claims you have or any third-party claims relating to the app.
  • • Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce these Terms against you.
  • • Product Claims: Any product claims, legal liability, or compliance issues are the sole responsibility of SmartSteals, not Apple.
  • • Intellectual Property: In the event of any third-party claim that the app infringes intellectual property rights, SmartSteals (not Apple) is responsible for investigation and defense.
  • • Apple EULA: Your use of the app must comply with the App Store Terms of Service and Apple's Licensed Application End User License Agreement (EULA).

Device Requirements

  • • iOS Version: The SmartSteals app requires iOS 13.0 or later
  • • Compatible Devices: iPhone, iPad, and iPod touch
  • • Internet Connection: Active internet connection required for full functionality
  • • Storage: Sufficient device storage for app installation and cached data
  • • Updates: We recommend keeping your iOS version and the app updated to the latest version for best performance and security

App Updates and Modifications

  • • We may update, modify, or discontinue any aspect of the app at any time without notice
  • • Updates may be required for continued use of the app
  • • We are not liable for any modifications, price changes, suspension, or discontinuation of the app
  • • You may need to update your iOS version to use new features

Geographic Restrictions

The SmartSteals iOS app is available in the United States App Store. Deals featured in the app are primarily for U.S. retailers. If you access the app from outside the U.S., you are responsible for compliance with local laws.

No In-App Purchases

The SmartSteals app is free to download and use. We do not currently offer in-app purchases or subscriptions. All deals redirect you to external retailer websites for purchases. Any purchases made through retailer websites are subject to the retailer's terms and conditions.

3. Affiliate Relationships and Compensation

Important Disclosure: SmartSteals participates in affiliate marketing programs and may earn commission when you make purchases through deal links on our platform.

  • • Affiliate Links: Many deals on our platform contain affiliate links. When you click these links and make a purchase, we may receive a commission from the retailer at no additional cost to you.
  • • No Price Impact: Our affiliate relationships do not affect the prices you pay. You receive the same deals and prices as you would by going directly to the retailer.
  • • Revenue Model: These affiliate commissions help us keep SmartSteals free for users while our AI systems continue to find and verify the best deals available 24/7.
  • • Deal Selection: Our affiliate relationships do not influence which deals our AI features. Our algorithms prioritize the best deals for users regardless of commission rates.
  • • Transparency: We are committed to transparency about our revenue model while focusing on providing the best possible deals and user experience.

4. User Accounts

SmartSteals uses passwordless authentication for your convenience and security. To access certain features, you may create a user account. You agree to:

  • • Provide accurate email information when creating your account
  • • Maintain the security of your email account (used for passwordless login)
  • • Notify us immediately of any unauthorized use of your account
  • • Be responsible for all activities that occur under your account
  • • Use the Service only for lawful purposes

🔒 Your Purchase Privacy is Protected

SmartSteals does NOT track or know what specific items you purchase from retailers.Your shopping privacy is completely protected.

  • • No Purchase Tracking: We do not track, store, or access your individual purchase history
  • • No Order Details: We never see what items you buy, quantities, or order information
  • • No Personal Shopping Data: Your purchases remain private between you and the retailer
  • • General Data Only: We only collect anonymized, general usage data from all users combined
  • • Commission Privacy: If we receive affiliate commissions, they contain no personal shopping details

Your shopping habits and purchases are completely private and unknown to SmartSteals.

5. Deal Information and Accuracy

  • • Verification Efforts: Our AI systems make reasonable efforts to verify deal information 24/7, but we cannot guarantee the accuracy, completeness, or availability of all deals.
  • • Price Changes: Prices, availability, and deal terms may change without notice. We are not responsible for discrepancies between information on our platform and retailer websites.
  • • Deal Expiration: Deals may expire or become unavailable at any time. We encourage users to act quickly on deals of interest.
  • • Retailer Terms: All purchases are subject to the terms and conditions of the respective retailers, not SmartSteals.
  • • No Purchase Guarantee: We do not guarantee that you will be able to complete a purchase through any deal link.

6. User Conduct

You agree not to:

  • • Submit false, misleading, or expired deal information
  • • Use the Service for any illegal or unauthorized purpose
  • • Attempt to gain unauthorized access to our systems or other users' accounts
  • • Interfere with or disrupt the Service or servers
  • • Submit spam, advertisements, or solicitations through our platform
  • • Violate any applicable laws or regulations
  • • Circumvent or manipulate our affiliate tracking systems

7. User-Generated Content

When you submit deals, reviews, or other content to SmartSteals:

  • • You retain ownership of your content but grant us a license to use, display, and distribute it on our platform
  • • You represent that you have the right to share the content and that it does not violate any third-party rights
  • • You agree that your content will not contain illegal, harmful, or inappropriate material
  • • We reserve the right to remove or modify user content at our discretion
  • • We may use submitted content to improve our Service and user experience

8. Intellectual Property

The SmartSteals platform, including its design, functionality, and content, is protected by copyright, trademark, and other intellectual property laws. You agree to:

  • • Not copy, modify, or distribute our proprietary content without permission
  • • Respect the intellectual property rights of SmartSteals and third parties
  • • Not use our trademarks, logos, or branding without authorization

9. Third-Party Retailers - No Liability or Responsibility

SmartSteals is ONLY a deals aggregation platform. We have NO relationship with, control over, or responsibility for any retailer, their products, services, or business practices. We simply display deals that are publicly available.

Complete Disclaimer of Retailer Liability

  • • NO Affiliation: SmartSteals has no business relationship, partnership, or affiliation with any retailer
  • • NO Control: We have no control over retailer operations, policies, inventory, or business practices
  • • NO Responsibility: We are not responsible for anything related to retailers or your interactions with them
  • • Independent Entities: All retailers are completely independent third parties

Shipping, Delivery & Order Fulfillment

  • • NO Shipping Responsibility: SmartSteals has no involvement in or responsibility for shipping, delivery, or fulfillment
  • • Late/Missing Deliveries: We are not responsible for delayed, lost, stolen, or damaged shipments
  • • Shipping Costs: All shipping fees, taxes, and additional charges are determined solely by retailers
  • • Order Processing: We have no control over how retailers process, fulfill, or ship orders
  • • Delivery Issues: Contact retailers directly for any delivery problems or tracking issues
  • • Address Errors: We are not responsible for incorrect shipping addresses or delivery failures

Product Quality, Safety & Defects

  • • NO Product Responsibility: We have no responsibility for product quality, safety, or functionality
  • • Defective Products: We are not responsible for defective, damaged, or non-working products
  • • Product Descriptions: We do not verify product descriptions, specifications, or images
  • • Health/Safety: We are not responsible for allergic reactions, injuries, or health issues from products
  • • Compatibility: We are not responsible for product compatibility or suitability for intended use
  • • Counterfeit/Fake Products: We cannot verify product authenticity and are not responsible for counterfeit items

Customer Service, Returns & Refunds

  • • NO Customer Service: SmartSteals provides no customer service for purchases - contact retailers directly
  • • Returns/Exchanges: We have no involvement in returns, exchanges, or refund processes
  • • Refund Disputes: We cannot help with refund disputes, denied returns, or customer service issues
  • • Warranty Claims: All warranties are provided by manufacturers/retailers, not SmartSteals
  • • Store Policies: Each retailer sets their own return, exchange, and customer service policies

Payment, Billing & Financial Issues

  • • NO Payment Processing: We do not process any payments - all transactions are with retailers
  • • Billing Issues: We are not responsible for billing errors, unauthorized charges, or payment disputes
  • • Credit Card Fraud: We have no involvement in payment security or fraud prevention
  • • Taxes: We are not responsible for sales tax calculations or tax-related issues
  • • Currency/Exchange: We are not responsible for currency conversion or exchange rate issues

Data Security & Privacy at Retailers

  • • NO Data Control: We have no control over how retailers handle your personal or payment information
  • • Data Breaches: We are not responsible for data breaches, security issues, or privacy violations at retailers
  • • Identity Theft: We are not responsible for identity theft or fraud occurring through retailer websites
  • • Privacy Policies: Each retailer has their own privacy policy that governs your data

Business Operations & Availability

  • • Store Closures: We are not responsible if retailers go out of business or close operations
  • • Policy Changes: We cannot control when retailers change their policies, prices, or terms
  • • Website Issues: We are not responsible for retailer website downtime, errors, or technical problems
  • • Stock Availability: We cannot guarantee product availability or inventory levels

Legal Disputes & Issues

  • • NO Legal Involvement: SmartSteals is not a party to any legal disputes between users and retailers
  • • Consumer Protection: Any consumer protection claims must be made directly against retailers
  • • Class Actions: We are not responsible for participating in class action lawsuits involving retailers
  • • Regulatory Issues: We are not responsible for regulatory violations or compliance issues at retailers

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING:

  • • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • • Warranties regarding the accuracy, reliability, or availability of deal information
  • • Warranties that the Service will be uninterrupted or error-free
  • • Warranties regarding third-party content or services

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTSTEALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING:

  • • Lost profits or savings from missed deals
  • • Issues arising from purchases made through retailer links
  • • Data loss or security breaches
  • • Service interruptions or technical problems

12. Indemnification

You agree to indemnify and hold SmartSteals harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or other reasons. You may also terminate your account at any time by deleting it through your account settings.

14. Governing Law and Jurisdiction

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Exclusive Jurisdiction and Venue

You agree that any legal action, suit, or proceeding arising out of or relating to these Terms, the Service, or your use thereof shall be brought exclusively in the state or federal courts located in Denver County, Colorado. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts on the basis of forum non conveniens or any other basis.

Important: By using SmartSteals, you agree that all disputes must be resolved in Colorado courts. This means you cannot sue SmartSteals in any other state or jurisdiction. This protects both parties by establishing a clear, predictable forum for resolving disputes.

15. Changes to Terms

We may update these Terms periodically. Material changes will be communicated through email or prominent notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
